Winning Edge Apps Privacy Policy
Introduction
Winning Edge Apps, Inc. ("Winning Edge Apps," "we," "our," or "us") provides mobile applications and related services, including Coach Brain and other movement-analysis products (collectively, the "Services"). This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use the Services.
By using the Services, you acknowledge the practices described in this Privacy Policy. Where applicable law requires consent for a particular collection, use, or disclosure, we will seek that consent as required.
1. Information We Collect
Account and contact information. We may collect information you provide, such as your name, email address, user or account identifier, team or organization information, athlete or roster information, profile information, support communications, and other information you choose to provide.
Photos, videos, and other user content. The Services may allow users to capture, upload, store, process, or share photographs, videos, athlete headshots, and other content ("User Content"). User Content may depict the user or other individuals, including athletes.
Movement and analysis information. When the Services process User Content, we may generate or collect information such as two-dimensional or three-dimensional pose information, skeletal or avatar animations, joint positions and coordinates, movement trajectories, joint angles, velocities, accelerations, timing information, biomechanical measurements, event classifications, annotations, performance metrics, technique assessments, analysis results, and related mathematical or analytical representations ("Derived Movement Data").
Device and usage information. We may automatically collect device model, operating-system version, app version, IP address, identifiers used to operate the Services, feature usage, interaction and diagnostic information, crash reports, performance information, and similar technical data.
Cookies and similar technologies. Our websites or web-based features may use cookies or similar technologies. Available controls may vary by browser, device, or service.
2. How We Use Information
We may use information to provide, maintain, secure, personalize, and support the Services; authenticate users; process and analyze movement; generate reports, animations, measurements, and other requested outputs; enable team and athlete workflows; communicate about the Services; troubleshoot technical issues; prevent fraud or misuse; comply with legal obligations; and enforce our agreements.
We may also use User Content and Derived Movement Data to research, develop, train, test, validate, evaluate, and improve our products, services, computer-vision systems, artificial-intelligence and machine-learning models, biomechanics technologies, movement-analysis technologies, algorithms, measurements, and analytical methods, subject to applicable law and the disclosures in this Privacy Policy.
3. De-Identified Movement Data and Research
We may create de-identified or aggregated movement datasets by removing direct identifiers and separating derived movement information from the source photographs and videos from which it was generated. De-identified movement data may include three-dimensional skeletal or avatar animations, raw numerical motion data, joint positions and coordinates, trajectories, joint angles, velocities, accelerations, timing information, biomechanical measurements, classifications, annotations, performance metrics, statistics, and other derived representations of human movement.
We may use de-identified or aggregated movement data for scientific research, educational research, benchmarking, statistical analysis, product development, model development and validation, and related research purposes. We may share such data with third parties, including universities, research institutions, sports organizations, biomechanics professionals, technology partners, and other researchers.
When we share de-identified movement data with third parties for these purposes, the shared research dataset will not include the source photographs or videos or direct identifiers such as the individual's name or email address. A shared dataset may include a skeletal or avatar animation representing an individual's movement and the underlying numerical motion data and derived biomechanical measurements.
We take reasonable measures designed to reduce the likelihood that shared de-identified movement data can be associated with an identifiable individual. Where appropriate, we may use contractual or technical safeguards that restrict recipients from attempting to identify or re-identify individuals represented in the data.
We do not sell personally identifiable athlete videos, photographs, or personal information to third parties for their independent marketing purposes.
4. How We Share Information
Service providers. We may disclose information to vendors and service providers that help us host, store, secure, analyze, support, communicate, process media, provide analytics, or otherwise operate the Services. We require service providers to handle information consistently with applicable contractual and legal obligations.
Research collaborators. As described above, we may share de-identified or aggregated movement data with research and technology collaborators. Research sharing under this provision does not include source photographs or videos or direct identifiers.
Team and user-directed sharing. Features of the Services may allow users to share content, analyses, or results with coaches, athletes, team members, organizations, or other people selected or authorized by the user.
Legal and safety reasons. We may disclose information if reasonably necessary to comply with law or legal process; protect the rights, safety, security, or property of Winning Edge Apps, our users, or others; investigate fraud or misuse; or enforce our agreements.
Business transactions. If Winning Edge Apps is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to applicable law.
5. User Content and Other People
If you upload, capture, or submit content depicting another person, you are responsible for having the rights, permissions, authorizations, and consents necessary to provide that content to Winning Edge Apps and permit us to process it as described in this Privacy Policy and the applicable terms of service or license agreement. This is especially important when content depicts minors.
6. Children's Privacy
The Services are not directed to children under 13 for independent use. We do not knowingly permit a child under 13 to create an account or knowingly collect personal information directly from a child under 13 without any consent required by applicable law. If we learn that we have collected personal information from a child in a manner not permitted by law, we will take appropriate steps to delete or otherwise address that information.
Some Services may be used by coaches, parents, organizations, or other authorized adults in connection with youth athletes. The adult or organization submitting information about a minor is responsible for obtaining any permissions or consents required for that submission and use. Additional requirements may apply when the Services are used by schools or other organizations subject to specific student-privacy laws.
7. Data Retention and Deletion
We retain information for as long as reasonably necessary to provide the Services, maintain legitimate business records, comply with legal obligations, resolve disputes, enforce agreements, protect the Services, and accomplish the purposes described in this Privacy Policy.
You may request deletion of personal information associated with your account by using any deletion functionality provided in the applicable Service or by contacting us at info@winningedgeapps.com. We may retain information when required or permitted by law, for security or fraud-prevention purposes, or in backups for a limited period.
Deletion of an account or source User Content may not require deletion of information that has previously been de-identified or aggregated so that it is no longer reasonably associated with an identifiable individual, subject to applicable law. It also may not require deletion of generalized models, algorithms, statistical results, or research findings developed using information in accordance with this Privacy Policy.
8. Your Privacy Choices and Rights
Depending on where you live, you may have rights to request access to, correction of, or deletion of certain personal information, or to obtain information about certain disclosures or uses. You may also withdraw consent where processing is based on consent, subject to legal and technical limitations. To make a request, contact info@winningedgeapps.com. We may need to verify your identity before completing a request.
You may opt out of marketing communications by using the unsubscribe mechanism provided in the communication or by contacting us. Service-related communications may still be sent when necessary to operate your account or the Services.
9. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. No security system or method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. International Processing
Winning Edge Apps and its service providers may process information in the United States and other countries where we or our providers operate. Those locations may have data-protection laws different from the laws where you live. Where required, we use appropriate measures for international transfers.
11. Third-Party Services and Links
The Services may integrate with or link to third-party services. Those third parties may process information under their own privacy policies and terms. Winning Edge Apps is not responsible for the privacy practices of unaffiliated third parties.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated policy and revise the Effective Date. Where required by law, we will provide additional notice or obtain consent before materially different uses of information.
